Terms of Service

The agreement between you and ConsentChecks for using the service.

Last updated 2026-11-01 — draft pending legal review

1. Agreement

These terms are between [LEGAL ENTITY NAME], [REGISTERED ADDRESS] ("ConsentChecks", "we", "us") and the person or business that creates an account ("you"). By using the service you agree to them. If you accept on behalf of a company, you confirm you have authority to bind it.

2. The service

ConsentChecks provides a consent management platform: an embeddable consent banner, consent logging, analytics, a site scanner and related tools, delivered from app.consentchecks.com. We may improve, change or retire features, and will give reasonable notice of changes that materially reduce what your plan includes.

Not legal advice. ConsentChecks is a tool that helps you collect and record consent. Using it does not by itself make your website compliant with GDPR, ePrivacy, CCPA/CPRA or any other law. You remain responsible for your own compliance, your privacy notices and the accuracy of how you configure banner text and categories.

3. Accounts and access

You create your own account by signing up and confirming your email. We may decline, suspend or close any account at our discretion. Keep your credentials confidential and tell us promptly of any unauthorized use. You are responsible for activity under your account, including that of the logins and API keys issued for it.

4. Plans, fees and billing

Paid plans are billed in advance on a recurring basis through Stripe at the price shown when you subscribe. Subscriptions renew until cancelled; you can cancel at any time and the plan continues to the end of the paid period. Fees are non-refundable except where the law requires otherwise. Page-view allowances are soft limits: we will not switch off your banner for exceeding one, but we may ask you to move to a suitable plan. Taxes are additional where applicable. We may change prices with at least 30 days' notice, taking effect at your next renewal.

5. Your data and our role

You own the configuration and the consent records you generate through the service. For visitor data collected on your websites, you are the controller and we act as your processor under the Privacy Policy and, on request, a data processing agreement. You are responsible for having a lawful basis to use the service on your sites and for responding to requests from your visitors.

6. Acceptable use

You agree not to: use the service unlawfully or to deceive visitors about their choices; interfere with or probe the security of the service; scan sites you do not own or control; exceed or circumvent rate limits; resell or white-label the service without our written agreement; or reverse engineer it except as the law permits. We may suspend access that threatens the service or other customers.

7. Availability and support

We aim to keep the service available and the embed script fast and safe, but we do not guarantee uninterrupted service. The embed is designed so that a failure of the service never breaks your website. Support is by email at [email protected].

8. Intellectual property

We own the service, the software and our branding. You receive a limited, non-exclusive, non-transferable right to use the service and embed the script on sites you control while your account is active. Feedback you give us may be used without obligation.

9. Warranties and liability

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, and we are not liable for indirect or consequential losses, lost profits, or regulatory fines or penalties arising from your use of the service. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You may stop using the service and close your account at any time. We may suspend or terminate your account for breach of these terms. On termination your right to use the service ends and we will delete your data in line with the Privacy Policy, after giving you a reasonable opportunity to export your consent logs.

11. Changes to these terms

We may update these terms. We will post the new version and change the date above, and notify account holders of material changes by email. Continued use after the change takes effect means you accept it.

12. Governing law

These terms are governed by the laws of [GOVERNING LAW / JURISDICTION], and the courts of that jurisdiction have exclusive jurisdiction, subject to any mandatory consumer rights you have in your country of residence.
